CONSTITUTION OF THE
PAN-MALAYAN LABOUR PARTY, 1952
I.NAME & REGISTERED
OFFICE
The name of the
organisation shall be the PANMALAYAN LABOUR PARTY (hereinafter referred to as
the Party) and its registered office shall be at Kuala Lumpur or at such other
place as decided upon from time to time by the Executive Committee of the
Party.
II. OBJECTS OF THE PARTY
(1) To co-ordinate the activities of Labour and
Socialist organisations in Malaya in order to achieve national independence and
social justice and the political, social and economic emancipation of the
People, and more particularly of those who depend directly upon their own
exertions by hand or by brain for the means of Life and the securing for
workers by hand or by brain the full fruits of their industry and the most equitable
distribution thereof that may be possible through the co-operative ownership
and democratic control of the economic resources of the community.
(2) To co-operate with the Labour, Socialist, and other
organisations in this and other countries with a view to promoting the purpose
of the Council, and take common action for the promotion of a higher standard
of social and economic life in general for workers.
(3) To give efleet as far as may be practicable to
the principles, policy and programme from time to time approved by the council.
III MEMBERSHIP
(1) All Labour and Socialist organisations of
democratic composition, which accept the Constitution of the Party, shall be
eligible for membership of the Party.
(2) Every member organisation shall contribute 10 cents
per member that appears on its register of member per year to the funds of the
Party.
IV. MEETINGS OF THE PARTY
(1) Meetings of the Party shall be attended by the
followings:
(a) Delegates duly elected by each
member organisation to the number of one representative for each 100 members or
part thereof that appear on its register of members,
(b) Ex-officio members as follows:
(i) Members of
the Executive Committee oi the Party.
(ii)Federal and Singapore Legislative Councillors
who are members of member organisations of the Party.
Ex-officio members shall
have no voting power unless they are also duly elected delegates.
(2) The party shall meet regularly once in every
year and also at such other times as it may be convened by the Executive Committee
of the Party.
V. OFFICERS OF THE PARTY
(a) The party at its Annual Meeting shall elect an
Executive Committee consisting of a Chairman, a Vice-Chairman, a General
Secretary, a Treasurer, and one member nominated by each member organisation of
the Party.
(b) Members of the Executive Committee shall
normally hold office for one year and shall be eligible for re-election.
(c) The executive Committee shall subject to the
control and direction of the Party, be the administrative authority of the
Party.
(d) The Executive Committe shall meet at least once
every quarter. Five members shall form a quorum.
(e) The Party at its Annual Meeting shall appoint
two delegates to act as Auditors of the Party.
(f) Only delegates of member organisations of the
Party are eligible for election to any office in the Party. 1
(g) Any vacancy which occurs among the members of
the Executive Committee or the auditors between Annual Meetings of the Party
shall be filled by the Executive Committee by co-option.
(h) The Executive Committee shall have power to
appoint sub-committees and perform any other lawful act to further the
interests of the Party.
6.RATIFICATION
No decision of the Party
shall be binding until it has been ratified by the Executive bodies of more
than half of the member organisations of the Party, such ratification to be effected
before the next quarterly meeting of the Executive Committee of the Party.
7.STANDING ORDERS
Any standing orders
adopted by the Party shall be considered for all purposes as if they form part
of this Constitution, and shall have effect accordingly.
8.AMENDMENTS
The constitution and
standing orders or any part thereof may be amended, rescinded, altered, or
additions made thereto by resolution carried at a meeting of the Party by a
simple majority of delegates present, but shall not have effect until ratified
by at least 2/3 of member organisations.
9.DISSOLUTION
The party may be
dissolved by resolution carried at a meeting of the Party by a majority of 2/3
of the delegates present subject to its ratification by at least 3/4 of the
member organisations of the party.
